Terms of Service

1.Acceptance of Terms

By accessing or using GenomeInsight (“the Service”), operated by GenomeInsight, Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email or in-app notification.

2.Service Description

GenomeInsight is an informational and educational genetic analysis platform. It is NOT a medical device, clinical laboratory, or diagnostic test. The Service does not provide medical advice, diagnosis, or treatment recommendations.

The Service allows users to:

  • Upload raw genetic data files from third-party providers (e.g., 23andMe, AncestryDNA, clinical VCF files)
  • Receive informational reports on health risk associations, pharmacogenomic markers, carrier status, ancestry composition, and traits based on published peer-reviewed research
  • Explore educational content about genetics and genomic science

All genetic analysis is performed entirely client-side (in your web browser). Your raw genetic data is never uploaded to our servers. See our Privacy Policy for details.

3.User Responsibilities

By using the Service, you represent and agree that:

  • You are at least 18 years of age or have parental/guardian consent
  • You will only upload genetic data that belongs to you or for which you have legal authorization to analyze
  • You understand that results are informational only and will not use them as a substitute for professional medical advice
  • You will consult qualified healthcare providers before making any medical decisions based on information obtained from the Service
  • You will not use the Service to discriminate against any individual based on genetic information
  • You will not attempt to reverse-engineer, decompile, or disassemble the Service or its underlying algorithms
  • You will not use automated tools (bots, scrapers) to access the Service
  • You will maintain the security of your account credentials

4.Data Processing

Client-Side Processing: All genetic data parsing and analysis occurs locally in your web browser using JavaScript/WebAssembly. Your raw genetic data file is read by your browser and never transmitted to our servers.

What We Store on Our Servers:

  • Account information (email, name, hashed password)
  • Payment and transaction records (processed via Stripe)
  • Aggregated report metadata (risk category scores, not individual variant data) — only if you choose to save your report
  • Usage analytics and application logs

What We Never Store:

  • Your raw genetic data file
  • Individual genotype data (e.g., specific rsID values)
  • Any data that could be used to reconstruct your genome

5.Intellectual Property

The Service, including its design, software, algorithms, SNP databases, analysis methodologies, text content, graphics, and user interface, is the intellectual property of GenomeInsight, Inc. and is protected by copyright, trade secret, and other intellectual property laws.

Your Data: You retain all rights to your genetic data. We claim no ownership of your uploaded files or genetic information. The reports generated by the Service are provided for your personal use.

Research Citations: Our analyses reference published peer-reviewed research. Citations to original studies (ClinVar, GWAS Catalog, PharmGKB, CPIC) are provided for transparency. These databases are the intellectual property of their respective owners.

6.Medical & Scientific Disclaimers

This report is for INFORMATIONAL and EDUCATIONAL purposes only. It is NOT a medical diagnosis.

  • Not a diagnostic test: GenomeInsight is not a clinical laboratory and this analysis is not a clinical diagnostic test. We are not FDA-cleared or approved for diagnostic use.
  • Not medical advice: Results should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.
  • Genetic risk ≠ certainty: Genetic risk factors indicate statistical associations, not certainties. Most conditions are influenced by lifestyle, environment, and multiple genes not covered by our analysis.
  • Pharmacogenomics caution: Pharmacogenomics results should be confirmed with clinical-grade testing before making any changes to medications. Never start, stop, or change medications without consulting your prescribing physician.
  • Carrier status limitations: Carrier status results do not cover all possible mutations. Clinical carrier screening is more comprehensive and should be used for family planning decisions.
  • Data limitations: Results are based on published research as of the date of analysis and may not account for all known or unknown genetic factors. Consumer genotyping arrays analyze a subset of all human genetic variation.
  • Population-specific accuracy: Many genetic studies have been conducted primarily in European-ancestry populations. Results may be less accurate for individuals of other ancestries.

7.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENOMEINSIGHT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any medical decisions made based on information provided by the Service
  • Any inaccuracies, errors, or omissions in the analysis results
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.GINA Compliance

Genetic Information Nondiscrimination Act (GINA)

This Service complies with the Genetic Information Nondiscrimination Act of 2008 (GINA). Under GINA, your genetic information cannot legally be used against you by health insurers (Title I) or employers (Title II).

Our commitments under GINA:

  • We will never share your genetic data with health insurers, employers, or any third party without your explicit consent
  • We display GINA information prominently throughout the Service
  • We provide clear consent forms for all data processing
  • We allow complete data deletion upon request

Important GINA limitations: GINA does not cover life insurance, disability insurance, or long-term care insurance. GINA does not cover military personnel. Some states provide additional protections beyond GINA — consult your state's genetic privacy laws for more information.

9.Accounts & Payments

Accounts: You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Payments: Paid features are processed through Stripe. All purchases are one-time payments unless otherwise indicated. Refund requests are handled on a case-by-case basis within 30 days of purchase. Contact henry.m.martinez93@gmail.com for refund inquiries.

Termination: We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings or by contacting us.

10.Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11.Miscellaneous

Severability: If any provision of these Terms is held invalid, the remaining provisions continue in effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GenomeInsight regarding the Service.

No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
